SSDI Applications and Appeals
In the state of Pennsylvania, initial applications for SSDI are reviewed by the Department of Disability Services (DDS). DDS reviews applications within about 90 to 120 days. The initial review is based on paperwork and medical records.
If your initial application for SSDI is denied, the next step is to request a hearing before an administrative law judge (ALJ). The current waiting time in Pennsylvania is approximately 14 months. It’s a single hearing with testimony before an ALJ. The judge will accept or deny your claim for benefits. If your claim is denied, you can appeal to the Social Security Appeals Council. Further appeal to the U.S. District Court is available if your claim is denied by the Social Security Appeals Council.
Our attorney, Terence McGraw, has handled appeals before ALJs, the Social Security Appeals Council and the U.S. District Court and the U.S. Court of Appeals for the Third Circuit. If your claim for SSDI benefits has been denied, we encourage you to contact our law office immediately to begin the appeals process.
